Travel Counsellors - Terms and Conditions
WE ACT AS AN AGENT FOR THE SUPPLIERS WHOSE TRAVEL AND OTHER SERVICES YOU ARE BUYING.
THE LIMITATIONS OF OUR LIABILITY WITH RESPECT TO SUCH SERVICES ARE DETAILED BELOW.
PLEASE READ THESE TERMS AND CONDITIONS BEFORE COMPLETING YOUR BOOKING. THEY FORM
AN ESSENTIAL PART OF YOUR CONTRACT WITH US. THAT CONTRACT IS LIMITED TO THE SERVICES
THAT WE PROVIDE, AND DOES NOT EXTEND TO THE SERVICES PROVIDED BY OTHERS.
PARTIES
“You” refers to the person making the booking and all passengers on whose behalf
he/she affects a booking. The person making the booking confirms that he/she is
at least 19 years old and has the authority to bind all of the other passengers
included in such booking, and also agrees to communicate to all of the other passengers
all of the information provided by us and by the various suppliers.
“We” and “us” refers to Travel Counsellors (Canada) Ltd., and all of its officers,
directors, agents, employees, contractors and shareholders.
ACKNOWLEDGEMENT OF TERMS & CONDITIONS
We reserve the right to modify these Terms and Conditions at any time, without prior
notice to you. Changes will be posted on our website, being www.travelcounsellors.ca.
Please read them carefully each time you make a new booking, or modify an existing
one, and verify with it any changes to this written version of them, which is accurate
as of the Effective Date set forth below. Your purchase through us commits you to
the Terms and Conditions in effect at the time the booking is accepted.
Please also read carefully the Terms and Conditions of your specific supplier(s),
with whom you are contracting. Copies of supplier Terms and Conditions are available
on request. Please check your booking confirmation and travel documents as soon
as you receive them, and notify your Travel Counsellor immediately of any discrepancies
or queries you may have
ERRORS AND OMISSIONS
We make every effort to ensure that the content on our Web Site and the information
that we provide to you is complete and current. However, we do not guarantee the
completeness or accuracy of all such information. Despite our best efforts, there
may be errors, inaccuracies or omissions with respect to price, availability or
description. We accordingly reserve the right to correct any error, inaccuracy or
omission without prior notice to you. We also reserve the right to refuse or to
cancel any reservation containing an error, inaccuracy or omission, whether or not
the reservation has been submitted by you. Where your credit card has been charged
and your reservation is later cancelled, we will issue a credit to your credit card.
PRICES
All prices are quoted in Canadian dollars, and all charges will be processed in
Canadian dollars, unless stated otherwise. All applicable federal and provincial
taxes will be charged to you at time of sale. Deposits are non-refundable.
Prices listed on our Web Site or in our written or oral advertizing are subject
to availability and to confirmation. Confirmation will not be final until the booking
process is complete and the supplier has unconditionally accepted your booking.
You agree to pay for all charges as indicated in our invoice.
DEPOSIT AND FINAL PAYMENT
A deposit, as required by the relevant suppliers’ terms and conditions, will be
taken at time of booking. That deposit is non-refundable. No prices are guaranteed
until a booking has been confirmed by the payment of a deposit or, in some cases,
full payment.
The deposit forms part of your final payment. If we do not receive final payment
by the specified date, we reserve the right to cancel the reservation. In the case
of billing errors, we reserve the right to re-invoice with correct pricing.
CANCELLATIONS AND CANCELLATION FEES
All suppliers outline their cancellation policy in their Terms and Conditions. Cancellation
must be received in writing from the passenger named on the booking. The date on
which we receive your written cancellation will determine the amount to be charged
as per the supplier terms.
The cancellation charge will be confirmed to you by your Travel Counsellor. Any
changes to your itinerary may incur additional costs. Flight changes after deposit
is received or flight cancellations after tickets are issued incur airline revision
and airline cancellation fees. If a supplier cancels a reservation we will attempt
to re-book passengers on a similar alternative.
All re-bookings are subject to availability. We cannot assume responsibility for
any additional costs or fees relating to the issuance and/or cancellation of air
tickets for other travel arrangements made.
REFUNDS
Refunds are processed by the supplier(s) and are subject to the terms and conditions
of each respective supplier. We will assist you where appropriate to seek a refund
from a supplier.
NON-REFUNDABLE AIR TICKETS
If you are purchasing a non-refundable air ticket, please make sure that your Travel
Counsellor explains the restrictions associated with non-refundable airfares. We
cannot be held responsible for any change/cancellation penalties associated with
these non-refundable airfares.
SERVICE FEES
Service fees charged at the time of booking are also non-refundable. All charges
are per person/ticket and are non-refundable. These charges are in addition to any
charges which may be imposed by the supplier.
TRAVEL INSURANCE
WE STRONGLY RECOMMEND THAT YOU PURCHASE TRAVEL INSURANCE.
HEALTH REQUIREMENTS
You are responsible for choosing an itinerary which matches your physical abilities
and stated health. We recommend that you consult a physician with regard to immunizations
and any travel medicines well in advance of your travel date. Proper medical and
pharmaceutical precautions are the sole responsibility of the traveller.
Travel Counsellors assumes absolutely no responsibility regarding provisions of
medical care or evacuation. By forwarding payment, you certify that you do not have
any physical or mental conditions which would create a danger or hazard for you
or other travellers. Once any fees have been paid by you to Travel Counsellors,
medical circumstances will not be considered as exceptions to our cancellation policy
as set forth above.
TRAVELLERS WHO NEED SPECIAL ASSISTANCE
Any condition or disability requiring special attention must be reported to Travel
Counsellors at enquiry stage, so that we can make every effort to accommodate the
special needs of travellers and provide you with a holiday that is tailored to your
needs. We cannot be held responsible for any denial of services by carriers, hotels,
transfers or other independent suppliers. Please be aware that coaches, minibuses
or transfer vehicles may not be equipped with wheelchair ramps. Travellers who need
assistance must be accompanied by a qualified and physically able companion.
DISPUTES AND COMPLAINTS
We will make every attempt to ensure that every aspect of your travel arrangements
run smoothly. If in the rare event that you experience any difficulty or are unhappy
with the service provided, you must advise the supplier and Travel Counsellors immediately.
We will attempt to resolve any issue whilst you are away so that you can continue
to enjoy your trip without further difficulty. However, if you remain dissatisfied
you must contact Travel Counsellors in writing within 28 days of your return. Failure
to lodge a complaint and advise the supplier at your destination may impact on any
attempt to resolve further disputes.
BAGGAGE ALLOWANCE
Please contact your airline to find out the maximum luggage and carry-on requirements
as all excess luggage will be subject to additional charges by the airline.
NO GUARANTEE
Unless we have inserted the term 'guarantee' in writing on your tickets, invoice
or itinerary, we do not guarantee any of the supplier(s) rates, bookings, reservations,
connections, scheduling, or handling of baggage or other personal effects.
CHANGES
Any change made by you may be subject to a service fee, in addition to any other
supplier charges or penalties.
TRAVEL DOCUMENTATION
We will not be responsible for your failure to obtain and carry proper travel documentation.
A passport or (perhaps) other proof of Canadian citizenship is required for travel
outside Canada, and to return to Canada. We recommend that you travel with a Canadian
passport that is valid at least six months past your return date, and ensure that
you have all required visas for travel to other countries. Even with travel documentation,
we cannot guarantee that you will be granted entry to another country, upon arrival.
LIVING STANDARDS
Living standards and customs, religion, political perspectives and local practices
at your destination may well vary from those prevailing at your point of departure.
This includes the quality and availability of utilities, services and accommodations.
You acknowledge that there may be a different environment at destination (and/or
en route to or from it) than you are accustomed to, and that these differences are
an integral part of your travel experience. You agree that we are not responsible
for any disruption or inconvenience that you experience as a result.
LIMITATION OF LIABILITY
We are not the suppliers of the travel services. Instead, we work with various suppliers
of travel services (the “Independent Parties”) to provide you with the services
and products that you purchase through us. We take care in selecting these Independent
Parties. However, we do not have control over them. We therefore cannot be held
responsible for any negligence, fault, or omission on their part or on the part
of their employees or for any damages that you suffer as a result thereof. All services
and products provided by the Independent Parties are subject to their own terms
and conditions and their liability is limited by their tariffs, terms and conditions,
conditions of carriage, tickets, vouchers international conventions and agreements.
We are not responsible for the failure in the provision of any of the obligations
of the Independent Parties, including any loss or damage resulting from any delay,
cancellation, weather condition, loss of personal items, illness or injury. Your
remedy will lie with the Independent Party, and not us.
NON WAIVER
None of our employees, agents or representatives has the authority to modify, waive
or alter any provision of these Terms & Conditions.
GOVERNING LAW
Any reservation made with us shall be governed by the applicable laws of the province
of Ontario and the laws of Canada applicable therein.
You consent and submit to the exclusive jurisdiction of the Ontario courts located
in the City of Toronto, in the Province of Ontario, Canada, with respect to all
disputes or claims for damage or any other relief arising out of or relating to
any travel service obtained from or through us.
PRIVACY POLICY
Please refer here
or request a hard copy of our Privacy Policy, which is subject to change from time
to time without prior notice.
SEVERABILITY
In the event that any provision of these Terms and Conditions is determined to be
unenforceable or invalid, such determination shall not affect the validity and enforceability
of any other remaining provisions.
EFFECTIVE DATE
These Terms and Conditions take effect on September 24, 2008, and are subject to
amendment and revocation as set forth above.
